Consider this scenario. Tom had just finished his hot dog, and he put his soda on the ground in front of his chair. He and his brother had third row seats between home plate and third base at Yankee Stadium. As he sat back up, a foul ball hit by Derek Jeter was coming directly at him. Luckily, his brother reached in front of Tom's face with his mitt and caught the ball. But what if Tom had sustained injuries as a result of being hit with Jeter's foul ball?
